PROBATE PROCESS

As an Executor you’re now tasked with overseeing the winding up and legal transfer of the estate of the deceased whose will you were named in. Only once an estate has been fully valued, that value accepted by Inland Revenue and any Inheritance Tax due is paid is Probate finally granted and the estate left to you becomes yours to do with as you see fit. How long the process takes can depend on the complexity and type of estate left in the will but is often around six months. What you need to do now is gather together an accurate and reliable set of valuations of what has been left in the estate to assess it for Inheritance Tax liability.

REAL ESTATE

Real estate property – houses, apartments, commercial property, land etc – often carries the highest value of an estate left in a will. We do not carry out real estate valuations and strongly suggest you consider obtaining a valuation by an RICS Surveyor for probate. This will usually deliver a valuation that is compliant with the Inland Revenue S160 Inheritance Tax Act 1984. Real estate valuations are often the most likely elements of probate valuation to be challenged by Inland Revenue if they seem at odds with the market and assessment by an RICS Survyeor is more usually considered indepedent and impartial.

CONTENTS & EFFECTS

In addition to real estate property you will likely have inherited the entire contents of the property and personal items such as jewellery, books, art etc. These too will require accurate and compliant valution for probate. WHAT WE DO

We realise this may be a difficult time and will always undertake the process of probate valuation with tact and sensitivity. It’s usually best to leave all items in place in any property which is also part of the bequest and arrange for valuation in situ, unless you have security concerns for any items which you think may be of particular value.  Once a convenient time and date is agreed, we will carry out a full inspection of the property and inspect any items of interest. Full photographic evidence is taken of both rooms as a whole and of any items of specific value. We will then compile a report that details the valuation and any other findings for your records. Our report will be compliant with the requirements of the Inland Revenue S160 Inheritance Tax Act 1984 and less likely to be challenged by the Inland Revenue. We keep records of all valuations and further copies may always be requested if you need them in future.

AFTER PROBATE

Once Probate has been granted, as an Executor you may also need to clear an inherited property of its contents prior to resale. We also offer a full or part house clearance service. We always undertake to treat the property with respect and due care, and to leave behind a neat, clear property ready for the next phase.
